Welcome to Mqaad, an electronic platform operated by Al Maqaad Digital Company (“Mqaad,” “we,” “us,” or “our”) in the Kingdom of Saudi Arabia.
These Terms of Service (“Terms”) govern your access to and use of the Mqaad website, platform, and related services.
By accessing Mqaad, creating an account, listing a ticket, purchasing a ticket, or otherwise using our services, you agree to be bound by these Terms and our Privacy Policy.
If you do not agree to these Terms, you must not use the Platform.
Mqaad operates an electronic marketplace that facilitates transactions between users who wish to sell tickets (“Sellers”) and users who wish to purchase tickets (“Buyers”) for sporting events, concerts, entertainment events, and other events.
Unless expressly stated otherwise, Mqaad acts as an intermediary between Buyers and Sellers and is not the organizer, promoter, venue operator, or original issuer of the tickets listed on the Platform.
Tickets offered on Mqaad are generally listed by third-party Sellers.
To use certain features of Mqaad, you may be required to create an account and provide accurate and complete information.
You agree to:
You are responsible for activities conducted through your account to the extent permitted by applicable law.
Mqaad may request additional information or verification documents where reasonably necessary for security, fraud prevention, payment processing, regulatory compliance, or protection of Platform users.
When purchasing a ticket through Mqaad, the Buyer agrees to carefully review the ticket listing before completing the purchase.
This includes, where applicable:
By confirming an order, the Buyer agrees to pay the total amount displayed before completing the transaction.
A completed order constitutes a commitment to purchase, subject to these Terms.
Sellers must have the lawful right to list and transfer any ticket offered through Mqaad.
By listing a ticket, the Seller represents and warrants that:
Mqaad may remove or suspend any listing that appears inaccurate, fraudulent, suspicious, prohibited, or otherwise inconsistent with these Terms.
Ticket prices displayed on Mqaad may be determined by individual Sellers and may differ from the original face value of the ticket.
Depending on demand, availability, event popularity, and other market factors, a ticket may be listed above or below its original price, subject to applicable laws and restrictions.
The Buyer is responsible for reviewing and accepting the final price displayed before completing the purchase.
Mqaad may charge Buyers, Sellers, or both service fees or other applicable charges for transactions conducted through the Platform.
Any applicable charges payable by the Buyer will be disclosed before the purchase is completed.
Fees applicable to Sellers may be deducted from the Seller’s payout or charged as otherwise communicated by Mqaad.
Payments may be processed through authorized third-party payment service providers.
By making a payment through Mqaad, you authorize Mqaad and its payment service providers to process the transaction and any applicable fees.
Mqaad may delay, withhold, cancel, or review a transaction where reasonably necessary to investigate suspected fraud, payment disputes, unauthorized transactions, regulatory requirements, or violations of these Terms.
Mqaad may temporarily hold the amount paid by the Buyer until the applicable transaction requirements have been satisfied.
Seller payouts may be subject to:
Where a transaction is disputed or suspected to involve fraud or a violation of these Terms, Mqaad may temporarily delay the Seller’s payout while the matter is reviewed.
Tickets may be delivered electronically or through another method specified in the relevant listing or transaction.
Sellers are responsible for providing tickets within the required timeframe and using the delivery or transfer method applicable to the event.
Buyers are responsible for providing accurate information necessary to receive transferred tickets and for checking their account, email, or other applicable delivery channels.
Delivery times may vary depending on the event, ticket issuer, Seller, and transfer method.
Mqaad aims to provide Buyers with a safe and reliable purchasing experience.
If a Buyer receives a ticket that is invalid, materially different from the listing, or cannot be used due to an issue attributable to the Seller, the Buyer should contact Mqaad as soon as reasonably possible.
Mqaad may investigate the transaction and, depending on the circumstances and available evidence, may:
Mqaad may request documents, screenshots, communications, venue confirmation, or other evidence when reviewing a claim.
Buyer protection does not apply to circumstances caused by the Buyer, including failure to attend the event, failure to follow ticket transfer instructions, or providing incorrect information.
Except where required by applicable law or expressly provided under Mqaad’s Buyer Protection, completed ticket purchases are generally final.
A Buyer is generally not entitled to a refund solely because they:
Where permitted, users who can no longer attend an event may be able to list eligible tickets for resale through Mqaad.
This does not affect any rights that cannot legally be excluded under applicable law.
Events are organized and controlled by third parties, not Mqaad.
If an event is cancelled, postponed, rescheduled, relocated, or otherwise modified, Mqaad will handle affected transactions in accordance with applicable law, the circumstances of the event, the original ticket issuer’s policies where relevant, and any applicable Mqaad policies.
A postponed or rescheduled event does not automatically entitle the Buyer to a refund unless required by applicable law or otherwise determined by Mqaad based on the circumstances.
Admission to an event is ultimately controlled by the event organizer, venue, or ticket issuer.
Users are responsible for complying with event-specific requirements, which may include:
Mqaad is not responsible for denial of entry resulting from a user’s failure to comply with applicable event or venue requirements.
Users must not use Mqaad to:
Mqaad may investigate suspected violations and take appropriate action.
Mqaad may restrict, suspend, or terminate an account where reasonably necessary, including where:
Where appropriate, Mqaad may request additional verification before restoring access to an account.
The Mqaad name, logo, website design, software, graphics, content, trademarks, and other intellectual property owned by or licensed to Mqaad are protected by applicable intellectual property laws.
Users may not copy, reproduce, modify, distribute, sell, exploit, or use Mqaad intellectual property without prior written authorization, except as permitted by law.
Third-party names, event logos, team logos, artist names, trademarks, and other intellectual property remain the property of their respective owners.
Mqaad may integrate with or provide access to third-party services, including payment providers, ticket transfer services, analytics providers, and external websites.
Mqaad does not control third-party services and is not responsible for their independent terms, policies, availability, or practices, except to the extent required by applicable law.
To the maximum extent permitted by applicable law, Mqaad will not be liable for indirect, incidental, special, or consequential losses arising from circumstances outside Mqaad’s reasonable control.
Because Mqaad acts primarily as an intermediary marketplace, Mqaad is not responsible for the organization, performance, scheduling, quality, or content of an event.
Nothing in these Terms excludes or limits any liability or consumer right that cannot legally be excluded or limited under the laws of the Kingdom of Saudi Arabia.
Your use of Mqaad is also subject to our Privacy Policy, which explains how personal data is collected, processed, stored, shared, and protected.
By using the Platform, you acknowledge that you have reviewed the Privacy Policy.
Mqaad may update these Terms from time to time to reflect changes to our services, business operations, legal requirements, or Platform functionality.
The latest version will be published on the Platform together with the date of the most recent update.
Where required by applicable law, users will be notified of material changes or asked to provide renewed consent.
These Terms are governed by the applicable laws and regulations of the Kingdom of Saudi Arabia.
Any dispute arising from or relating to these Terms or the use of Mqaad shall be subject to the jurisdiction of the competent authorities and courts in the Kingdom of Saudi Arabia, unless otherwise required by applicable law.
